A North County Transit District Bus driver was charged yesterday with driving under the influence of alcohol, and also with driving a commercial vehicle with a blood alcohol level greater than 0.04%. The driver, David Costello, was arrested on June 1 after a passenger who suspected the driver was intoxicated called the Sheriff’s department on his cell phone. Sheriff’s deputies were than able to pull the bus over in Encinitas as it was heading east on Encinitas Boulevard near Calle Magdalena. Field sobriety tests were conducted, and it was determined that Costello showed signs of being under the influence.
It is interesting to note that a driver with just 0.04 blood alcohol level is considered to be driving under the influence if he is driving a commercial vehicle.
