How will “Godzilla” El Nino Affect Construction Defect Claims

The focus of a recent article in the Los Angeles Daily Journal was that construction litigation had decreased markedly in California over the last several years, primarily due to the lack of water intrusion because of drought conditions.  The predicted massive El Nino may change all that.  Recent projections by the National Oceanic and Atmospheric Administration predict that one of the largest El Nino’s in recent years is headed to west coast.  The large amount of rain will not only result in the obvious leaks to roofs and windows, but may affect soil subisdence or other soil movement issues for years to come.  Soil either swells or contracts with the introduction of water.  Massive amounts of rain will saturate the soils, and may result in movement for several years.
